Think again. California\u2019s new \u201cno touch\u201d phone law makes even holding your phone behind the wheel a violation. The rule, which is part of the state\u2019s effort to curb <a href=\"https:\/\/dklaw.com\/the-fine-print\/how-to-prevent-distracted-driving\/\">distracted driving<\/a>, has already led to thousands of citations since its implementation.\u00a0<\/p>\n\n\n\n<p>This guide explains what the law covers, recent court rulings that expanded its reach, and what drivers can do to stay compliant (and ticket-free). <\/p>\n\n<\/div><\/div>\n\n<div class=\"dklaw-toc__block align wp-block-dklaw-toc-block\"><div class=\"acf-innerblocks-container\">\n\n<h2 class=\"wp-block-heading\">Understanding the \u201cNo-Touch\u201d Phone Law<\/h2>\n\n\n\n<p>Under <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?sectionNum=23123.5.&amp;lawCode=VEH\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>California Vehicle Code \u00a7 23123.5<\/strong><\/a>, drivers are prohibited from holding or operating a handheld wireless telephone or electronic device while driving. Update to an existing law that prohibits texting while driving.&nbsp;California is one of 31 states that have enacted a no-touch law. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">A Key Legal Update<\/h3>\n\n\n\n<p>In June 2025, the California Court of Appeal clarified the law\u2019s intent in <em>People v. Nathaniel Porter<\/em>.
