California calls these time-limited demands, and since January 1, 2023, Code of Civil Procedure sections 999 through 999.5 have governed them.

The rules matter more than their length suggests. A demand that follows them can put real pressure on an insurer to pay within the policy. A demand that doesn’t can lose most of its force.

Key Takeaways

CCP 999 covers demands made before a lawsuit is filed that offer to settle within the at-fault party’s insurance limits by a deadline.

It applies only to claims covered by auto, motor vehicle, homeowner, and commercial premises liability policies. That includes car crashes, dog bites, and many slip-and-fall claims.

The demand must give the insurer at least 30 days to respond if sent by email, fax, or certified mail, or 33 days if sent by regular mail.

An insurer that doesn’t accept must tell the claimant in writing, before the deadline, what it decided and why.

A demand that doesn’t substantially comply can’t be treated as a reasonable settlement offer in a later lawsuit over the insurer’s failure to settle. The rule doesn’t apply to people without a lawyer.

What is CCP 999?

CCP 999 is the California statute that sets the rules for pre-lawsuit, time-limited offers to settle an injury or property damage claim within the at-fault party’s insurance limits. It was created by Senate Bill 1155, signed in 2022, and it applies to demands sent on or after January 1, 2023.

The statute opens with a policy statement: California encourages prompt settlements because they benefit claimants, policyholders, and insurers. Everything that follows is about making those early offers clear enough that an insurer can evaluate them in time.

It only reaches certain claims. The chapter applies to causes of action covered under automobile, motor vehicle, homeowner, or commercial premises liability insurance policies.

What does a time-limited demand have to include?

A compliant demand has to be in writing and either labeled as a time-limited demand or reference the statute. It also has to give the insurer a minimum response window: at least 30 days from transmission by email, fax, or certified mail, or 33 days by regular mail.

The demand must also contain:

A clear offer to settle all claims within the policy limits, including satisfying all liens.

A release offer covering the insured for the claims being settled.

The date and location of the loss.

The claim number, if known.

A description of all known injuries the claimant has suffered.

Reasonable proof supporting the claim, which can include medical records or bills.

The demand has to go to the right place. Insurers designate an email or physical address for these demands, and the California Department of Insurance posts those addresses. Sending it to the adjuster assigned to the claim also works, if that person is known.

What does the insurer have to do?

The insurer can accept the demand in writing before the deadline. It can also ask for clarification, more information, or an extension, and the statute says a request like that is not, by itself, a counteroffer or a rejection.

If the insurer doesn’t accept, it has to notify the claimant in writing of its decision and the basis for it before the deadline runs out. That explanation can be used later in any lawsuit claiming the insurer should have paid more than the policy limits.

There’s no automatic extension. The deadline can move only if both sides agree to it.

What happens if a demand doesn’t follow the rules?

A demand that doesn’t substantially comply with CCP 999 can’t be treated as a reasonable offer to settle within the limits in a later lawsuit seeking damages beyond the policy. That later lawsuit is usually what gives a policy-limits demand its weight, so a defective demand loses most of its force.

People handling their own claims get a break. The non-compliance rule doesn’t apply to claimants who aren’t represented by a lawyer.

Compliance also doesn’t guarantee anything. The statute says it doesn’t change existing law on an insurer’s duty to settle, so a valid demand still has to be one a reasonable insurer should have accepted.

Why did California pass CCP 999?

Insurers pushed for it. The Senate Judiciary Committee’s analysis of SB 1155 records the industry’s complaint that time-limited demands had become a tactic to pressure insurers into settling before they could investigate, sometimes with as little as five days to respond, and to set them up for a bad faith lawsuit. The bill was sponsored by insurance trade groups and opposed by the Consumer Attorneys of California.

The version that passed is much milder than the one introduced. The original bill required a 45-day response window and strict compliance, and it would have made non-compliant demands inadmissible. Committee amendments shortened the timeline, moved the standard from strict to substantial compliance, and eased the documentation requirements.

That history explains why the law is narrower than some summaries suggest. It sets ground rules for both sides without making demands easy for insurers to dismiss on a technicality.

Does CCP 999 apply to dog bite and slip-and-fall claims?

Yes, when the claim is covered by a homeowner or commercial premises liability policy. A dog bite paid through the owner’s homeowners insurance falls inside the statute, which matters because many of those claims run up against the policy limit.

Claims under other types of coverage, like a professional liability policy, fall outside it.

What’s the Difference Between CCP 999 and a CCP 998 offer?

The two numbers sit next to each other in the code and do different jobs.

CCP 999 demand

CCP 998 offer

When it’s made

Before a lawsuit or arbitration is filed

After a lawsuit is filed, at least 10 days before trial or arbitration

What it offers

Settlement within the insurance policy limits

Any amount either side chooses

Who it’s aimed at

The at-fault party’s liability insurer

The opposing party

What’s at stake

Whether the insurer can later be on the hook for amounts above the policy

Shifting of certain litigation costs if the other side does worse at trial

A CCP 998 offer is a litigation tool for managing cost risk. A CCP 999 demand is a pre-lawsuit tool aimed at the policy limits.

What should you do about a lowball first offer?

A first offer tells you where the insurer is starting, not what your claim is worth. California’s fair claims regulations require an insurer to accept or deny a claim within 40 days of receiving proof of claim, so an early number often arrives before your treatment is finished and before your losses are fully known.

When injuries clearly exceed the at-fault party’s coverage, a time-limited policy-limits demand is one way a lawyer can force a decision. It only works if it’s done right, with the documentation, deadlines, and delivery the statute requires.
