Pedestrians and other motorists can absolutely be liable for the crash. However, neither party should leave without providing their information. Of course, there are some scenarios where this may not be possible. For instance, an unconscious individual or someone who was taken away in an ambulance is one of the exceptions.&nbsp;<\/p>\n\n\n\n<p>Also, hit-and-run crashes don\u2019t always occur on the road. There is no hit-and-run because the driver caused damage to their own property.<\/p>\n\n<\/div><\/div>\n\n<div class=\"dklaw-toc__block align wp-block-dklaw-toc-block\"><div class=\"acf-innerblocks-container\">\n\n<h2 class=\"wp-block-heading\">How California Hit-and-Run Crashes Differ<\/h2>\n\n\n\n<p><a href=\"https:\/\/www.justia.com\/criminal\/docs\/calcrim\/2100\/2150\/\" target=\"_blank\" rel=\"noreferrer noopener\">California Vehicle Code section 20002<\/a>&nbsp;defines a misdemeanor hit-and-run crash as an accident that involves the following four elements:<\/p>\n\n\n\n<ol class=\"wp-block-list is-style-arrow-list\">\n<li><strong>First, a driver was involved in an accident with another party<\/strong><\/li>\n\n\n\n<li><strong>Second, the accident damaged property that did not belong to the driver<\/strong><\/li>\n\n\n\n<li><strong>Third, the driver was aware that the accident caused property damage<\/strong><\/li>\n\n\n\n<li><strong>Fourth, the driver did not provide contact and insurance information before leaving the scene<\/strong><\/li>\n<\/ol>\n\n\n\n<p>According to California law, it is okay for the driver to leave their written contact information at the scene of the accident. If the driver does this, it does not count as a hit-and-run accident.<\/p>\n\n<\/div><\/div>\n\n<div class=\"dklaw-toc__block align wp-block-dklaw-toc-block\"><div class=\"acf-innerblocks-container\">\n\n<h2 class=\"wp-block-heading\">What Are the Consequences of Hit-and-Run Crashes?<\/h2>\n\n\n\n<p>The consequences of a hit-and-run crash depend on the location and the severity of the accident.<\/p>\n\n\n\n<p>In some states, criminal penalties for a hit-and-run crash can range from 5&nbsp;to 10 years in prison or result in&nbsp;<a href=\"https:\/\/www.legislature.mi.gov\/(S(4avho1zce0fvkraer231em2p))\/mileg.aspx?page=getobject&amp;objectname=mcl-257-617\" target=\"_blank\" rel=\"noreferrer noopener\">fines of $5,000 to $10,000<\/a>. Penalties depend&nbsp;on the severity of the accident. For instance, if the other party is injured, that would affect the punishment.<\/p>\n\n\n\n<p>In California, Vehicle Code section 20002 deals with hit-and-run crashes that involve property damage.
