Negligence<\/h3>\n\n\n\n<p>First, you must prove the death of the deceased was caused in part or whole by:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-arrow-list\">\n<li><strong>The carelessness of the defendant<\/strong><\/li>\n\n\n\n<li><strong>The recklessness of the defendant<\/strong><\/li>\n\n\n\n<li><strong>Negligent actions of the defendant\u00a0<\/strong><\/li>\n<\/ul>\n\n\n\n<p>Negligence is the failure to act reasonably or according to the standard of care, resulting in injury or harm to another person. It\u2019s the most common foundation for wrongful death cases in California.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">2. Breach of Duty<\/h3>\n\n\n\n<p>Next, you need to prove that the defendant owed a legal duty to the deceased. Duty is the responsibility to act in a way that a rational person would in the same or similar circumstances. For instance, all drivers have the duty to drive safely and follow traffic laws to prevent collisions and injuries.<\/p>\n\n\n\n<p>You must identify how the defendant\u2019s duty exists and that the defendant breached the duty because of negligent actions. Examples of a motorist\u2019s breach of duty are:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-arrow-list\">\n<li><strong>Distracted driving<\/strong><\/li>\n\n\n\n<li><strong>Drunk driving<\/strong><\/li>\n\n\n\n<li><strong>Aggressive driving<\/strong><\/li>\n\n\n\n<li><strong>Reckless driving<\/strong><\/li>\n\n\n\n<li><strong>Violating traffic laws<\/strong><\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">3.
