It\u2019s real data, and it could come into play after an accident. Let\u2019s break down what your car might know about you \u2013 and who else might be listening.<\/p>\n\n<\/div><\/div>\n\n<div class=\"dklaw-toc__block align wp-block-dklaw-toc-block\"><div class=\"acf-innerblocks-container\">\n\n<h2 class=\"wp-block-heading\">1. What Kind of Data Is Your Car Collecting?<\/h2>\n\n\n\n<p>Modern vehicles \u2013 especially those made in the last 5\u201310 years \u2013 are loaded with sensors and software that track things like:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-arrow-list\">\n<li>GPS location and driving routes<\/li>\n\n\n\n<li>Speed, acceleration, and braking<\/li>\n\n\n\n<li>Seatbelt usage<\/li>\n\n\n\n<li><a href=\"https:\/\/dklaw.com\/the-fine-print\/is-my-car-a-total-loss-if-the-airbags-deploy\/\">Airbag deployment<\/a><\/li>\n\n\n\n<li>Entertainment system use<\/li>\n<\/ul>\n\n\n\n<p>Some cars even connect to apps or send this info to cloud servers owned by the manufacturer. A <a href=\"https:\/\/www.consumerreports.org\/electronics\/personal-information\/how-to-stop-your-car-from-collecting-sharing-driving-data-a1233378612\/\" target=\"_blank\" rel=\"noreferrer noopener\">Consumer Reports<\/a> investigation found that nearly every automaker that sells cars in the U.S. is collecting and sharing \u201cdriver behavior data\u201d with other companies.<\/p>\n\n<\/div><\/div>\n\n<div class=\"dklaw-toc__block align wp-block-dklaw-toc-block\"><div class=\"acf-innerblocks-container\">\n\n<h2 class=\"wp-block-heading\">2. That means insurance companies, law enforcement, or even third-party data brokers may gain access under the right conditions.<\/p>\n\n\n\n<p>In one <a href=\"https:\/\/www.nytimes.com\/2024\/03\/11\/technology\/carmakers-driver-tracking-insurance.html\" target=\"_blank\" rel=\"noreferrer noopener\">report<\/a>, a Seattle driver saw his insurance jump 21% after data from his Chevy Bolt was shared with LexisNexis, a global data broker.&nbsp;<\/p>\n\n\n\n<p>Your car\u2019s data may also be used after an accident, in addition to dashcam footage and witness statements.<\/p>\n\n<\/div><\/div>\n\n<div class=\"dklaw-toc__block align wp-block-dklaw-toc-block\"><div class=\"acf-innerblocks-container\">\n\n<h2 class=\"wp-block-heading\">3. It depends on how the data is stored, who it\u2019s shared with, and whether you consented (often buried deep in a user agreement).<\/p>\n\n\n\n<p>California\u2019s Consumer Privacy Act (CCPA) provides drivers with some protections, but enforcement hasn\u2019t yet kept pace with the rapid advancements in car technology. And here\u2019s the kicker\u2014most people don\u2019t even realize their vehicle is collecting this level of detail.<\/p>\n\n\n\n<p>If your car has Wi-Fi, Bluetooth, or a companion app, it\u2019s almost certainly tracking more than you think.<\/p>\n\n<\/div><\/div>\n\n<div class=\"dklaw-toc__block align wp-block-dklaw-toc-block\"><div class=\"acf-innerblocks-container\">\n\n<h2 class=\"wp-block-heading\">4. What Happens After a Crash?<\/h2>\n\n\n\n<p>If you\u2019re involved in a collision, your car\u2019s event data recorder (EDR)\u2014often called the \u201cblack box\u201d\u2014can reveal critical details, including:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-arrow-list\">\n<li>Speed and braking patterns before impact<\/li>\n\n\n\n<li>Whether safety systems (seatbelts, airbags) were engaged<\/li>\n\n\n\n<li>Data that supports\u2014or contradicts\u2014the police report<\/li>\n<\/ul>\n\n\n\n<p>This information can strengthen or weaken an insurance claim. And if the other driver\u2019s vehicle has similar data?
