When a jury awards money for your suffering, they don&#8217;t fill out a form that says &#8220;$10,000 for anxiety, $15,000 for pain, $5,000 for emotional distress.&#8221;<\/p>\n\n\n\n<p>They award one number. Kaiser Foundation Hospitals<\/a>. The court explained that &#8220;pain and suffering&#8221; is really just a convenient shorthand. It covers physical pain, sure. But also fright, nervousness, grief, anxiety, worry, shock, humiliation, and pretty much any other negative experience caused by the accident.<\/p>\n\n\n\n<p>So when people ask whether they can claim anxiety <em>in addition to<\/em> pain and suffering, the answer is: <a href=\"https:\/\/dklaw.com\/the-fine-print\/anxiety-compensation-car-accident-california\/\">anxiety is already part of pain and suffering<\/a>. You don&#8217;t file separate claims. You present evidence of everything you&#8217;ve been through, and the jury decides what the total package is worth.<\/p>\n\n<\/div><\/div>\n\n<div class=\"dklaw-toc__block align wp-block-dklaw-toc-block\"><div class=\"acf-innerblocks-container\">\n\n<h2 class=\"wp-block-heading\">Why the Distinction Still Matters<\/h2>\n\n\n\n<p>Even though these categories blend together legally, they matter practically. (This argument usually fails under California&#8217;s Eggshell Skull rule, but they&#8217;ll try anyway.)<\/p>\n\n\n\n<p><strong>Downplaying the severity.<\/strong> &#8220;Everyone feels nervous after a car accident.
