The lawyer won’t say whether the fee comes out before or after costs

Case costs are what the firm spends on your claim: filing fees, records, depositions, expert witnesses. They’re repaid from the settlement. The question is whether the lawyer’s percentage is taken from the full settlement or from what’s left after costs.

On a $300,000 settlement with $45,000 in costs and a one-third fee:

Method

Fee

You receive

Costs come out first

$85,000

$170,000

Fee comes out first

$100,000

$155,000

The gap always equals the fee percentage times total costs. On a $1 million case with $180,000 in costs at 40%, it’s $72,000. The State Bar’s sample fee agreement calculates the fee after costs. Ask to see the math on a hypothetical $100,000 settlement.

Medical liens are a separate deduction from case costs. Here’s how liens on settlement proceeds work in California.

3. The lawyer calls their percentage “standard”

No California law or State Bar rule sets a standard contingency percentage for injury cases. Section 6147(a)(4) requires your agreement to say the opposite: the fee is negotiable and not set by law. The State Bar’s own sample agreement leaves the percentages blank.

4. The fee jumps the day a lawsuit is filed

Many agreements raise the percentage partway through a case. Find the exact trigger. Filing a complaint can take an afternoon, while preparing for trial takes months of work.

Stanford law professor Nora Freeman Engstrom studied high-volume injury practices and found their fees escalated at filing, while the conventional practices she compared them to generally escalated when substantial trial preparation began. She also found that only about 23% to 31% of contingency lawyers nationally use tiered fees at all.

5. The lawyer claims to be a “certified personal injury specialist”

The State Bar of California currently certifies specialists in 11 areas (a 12th, Privacy Law, launches January 1, 2027), and personal injury isn’t one of them.

Under Rule of Professional Conduct 7.4(a), a lawyer can only claim certification from the State Bar or an accredited body, and the communication has to name that body.

A lawyer saying they specialize in or limit their practice to personal injury is fine. The word “certified” is the problem. The Certified Specialist Search settles it in under a minute. Outside California, check your own state bar’s list.

6. The lawyer has public discipline on their record

Discipline in California is public. Search any lawyer by name or bar number, and you’ll see license status, admission date, and any reproval, suspension, or disbarment.

What to check

Where

License status and discipline

State Bar attorney search

Specialist certification

State Bar Certified Specialist Search

File a complaint (free)

State Bar complaint portal

A clean record means no public discipline. Someone approached you at the hospital or called out of the blue

Rule 7.3(a) bans lawyers from soliciting clients through live, in-person, or real-time contact for financial gain. There’s no waiting period after which it becomes acceptable. Section 6152 makes it illegal to use “runners” or “cappers” to bring in cases, which covers tow drivers, hospital staff, or anyone else steering you toward a firm for a kickback.

Section 6152(b) adds a protection worth knowing: a general release of a liability claim signed during your first stay in a hospital or clinic, within 15 days of admission, is presumed fraudulent.

Ads, billboards, and websites aren’t solicitation. A stranger at your bedside is.

8. The lawyer guarantees a result or promises quick cash

California bans attorney advertising that guarantees an outcome or promises immediate cash or a quick settlement, under section 6157.2. A lawyer who names a dollar figure before reviewing your medical records and the insurance policies is guessing.

9. “No fee unless we win” with nothing said about costs

Under Rule 7.1, an ad promising no fee unless you recover can mislead if it doesn’t say whether you’ll still owe case costs. Ask directly: if you lose, who pays the costs?

10. You hear about a settlement offer after the fact

Rule 1.2(a) says you decide whether to settle. Not the firm. Rule 1.4.1 requires your lawyer to promptly tell you the amount and terms of every written settlement offer. If you learn about an offer weeks later, or only ever see the final number, raise it with the lawyer in writing.

To judge whether an offer is reasonable, it helps to know what similar claims have resolved for. If your intake was at one firm and your lawyer works at another, ask whether a referral fee is being paid.

12. Non-lawyer staff are giving you legal advice or quoting your fee

Paralegals can’t give legal advice or set fees under section 6450(b), and non-lawyers can’t share in legal fees under Rule 5.4(a). Case managers handling day-to-day work on your file is normal. Case managers telling you what your case is worth, or whether to take an offer, is not.

13. The lawyer says you can’t fire them, or that switching means paying twice

You can discharge your lawyer at any time, with or without a reason. The California Supreme Court settled this in Fracasse v. That amount comes out of the original contract fee, so the total doesn’t increase.
