The state does have a law that bans all drivers from using handheld cell phones while driving, but that law doesn\u2019t affect passengers.<\/p>\n\n\n\n<p><strong>There are a few exceptions to this rule:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list is-style-arrow-list\">\n<li>You can make an emergency call to law enforcement, the fire department, or a medical aide<\/li>\n\n\n\n<li>Those operating authorized emergency vehicles can use a phone<\/li>\n\n\n\n<li>If you may use a handheld phone if you are driving on private property<\/li>\n\n\n\n<li>A violation of the handheld cellphone ban will not count as a point on your driving record.<\/li>\n\n\n\n<li>The police are authorized to pull you over for breaking this law<\/li>\n<\/ul>\n\n<\/div><\/div>\n\n<div class=\"dklaw-toc__block align wp-block-dklaw-toc-block\"><div class=\"acf-innerblocks-container\">\n\n<h2 class=\"wp-block-heading\">Hands-Free Cell Phone Laws in California<\/h2>\n\n\n\n<p>Specific rules apply to drivers and hands-free cell phones. The total fine for a first-time violation will likely exceed $150, and a second offense might easily cost over $250.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Drivers 18 and Older<\/h3>\n\n\n\n<p>Drivers who are 18 years of age (or older) are allowed to use hands-free phones while driving. They can use a Bluetooth device (or another earpiece), but can\u2019t cover both ears. The law also permits drivers over 18 to use the speakerphone function on a wireless phone.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Drivers Younger Than 18<\/h3>\n\n\n\n<p>The law is much stricter for drivers under 18. They cannot use a pager, laptop, wireless phone, or any electronic communication device, even if it\u2019s hands-free. Again, there is an exception for using a wireless device in an emergency situation. California has imposed heavy fines to get young drivers to stop texting and driving.<\/p>\n\n<\/div><\/div>\n\n<div class=\"dklaw-toc__block align wp-block-dklaw-toc-block\"><div class=\"acf-innerblocks-container\">\n\n<h2 class=\"wp-block-heading\">Examples of Distracted Driving Behaviors<\/h2>\n\n\n\n<p>Being a distracted driver includes any task that takes your attention off the road. Texting, emailing, and using a navigation system are some of the most common forms of distracted driving. Speaking or listening to a cell phone made the risk of an accident 1 times as high as non-distracted driving. Text messaging made the odds of a crash (or near-crash) about 23 times higher than non-distracted driving. Drivers are 7 times more likely to crash when using or reaching for an electronic device.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Small Non-Commercial Vehicles<\/h3>\n\n\n\n<p>Dialing a cell phone made a driver almost three times more likely to cause a crash compared to a non-distracted driver. If a driver reaches for a cell phone, they are 1.5 times more likely to crash compared to non-distracted drivers. Speaking or listening to a cell phone made the risk of a crash about 1.3 times more likely compared to a non-distracted driver.<\/p>\n\n<\/div><\/div>\n\n<div class=\"dklaw-toc__block align wp-block-dklaw-toc-block\"><div class=\"acf-innerblocks-container\">\n\n<h2 class=\"wp-block-heading\">Distracted Driving Facts<\/h2>\n\n\n\n<p>Sending or reading text messages takes your eyes off the road for about 5 seconds on average. People using cell phones are 5 times more likely to get into a wreck than non-distracted drivers. A&nbsp;<a href=\"https:\/\/unews.utah.edu\/up-to-27-seconds-of-inattention-after-talking-to-your-car-or-smart-phone\/\" target=\"_blank\" rel=\"noreferrer noopener\">University of Utah study<\/a>&nbsp;found that talking on a mobile phone while driving is equal to driving with a .08% blood-alcohol level.<\/p>\n\n\n\n<p>Text messaging will increase the risk of a car crash by&nbsp;<a href=\"https:\/\/featured.vtti.vt.edu\/2013\/04\/april-is-distracted-driving-awareness-month\/#:~:text=The%20VTTI%20Driver%20Distraction%20in,crash%20risk%20by%2023%20times.\" target=\"_blank\" rel=\"noreferrer noopener\">about 23 times<\/a>. Distracted driving leads to almost 5,000 deaths a year in the United States. Even when people put away their phones, they are still distracted for up to 26 seconds. Over 650,000 drivers are using their cell phones while driving at any given minute.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Teen Drivers and Distracted Driving<\/h3>\n\n\n\n<p>It is not surprising that teen drivers are the most likely to be distracted behind the wheel. An\u00a0<a href=\"https:\/\/newsroom.aaa.com\/tag\/distracted-driving\/\" target=\"_blank\" rel=\"noreferrer noopener\">AAA study<\/a>\u00a0found that teenagers are distracted while driving about 25% of the time.
