It is something that none of us want to think about, losing a family member or loved one as a result of someone\u2019s wrongful act.<\/p>\n\n\n\n<p>California\u2019s \u201cwrongful death\u201d law will let families recover damages when a loved one dies due to someone\u2019s wrongful act. This law is set forth officially in the&nbsp;<a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?lawCode=CCP&amp;sectionNum=377.60.\" target=\"_blank\" rel=\"noreferrer noopener\">California Code of Civil Procedure 377.60<\/a>.<\/p>\n\n\n\n<p>A wrongful death claim is a civil lawsuit. It is brought to the courts directly by the survivors of the deceased, or it is brought by the personal representative of the deceased person\u2019s estate, and fault is only expressed in terms of money. This statute allows the parties listed below to bring a wrongful death claim:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-arrow-list\">\n<li><strong>The deceased person\u2019s living children<\/strong><\/li>\n\n\n\n<li><strong>The deceased person\u2019s surviving spouse<\/strong><\/li>\n\n\n\n<li><strong>The deceased person\u2019s domestic partner<\/strong><\/li>\n<\/ul>\n\n\n\n<p>In the instance when there is no surviving person in the deceased person\u2019s line of descent, then a wrongful death lawsuit can be initiated by anyone \u201cwho would be entitled to the property of the decedent by intestate succession.\u201d<\/p>\n\n\n\n<p>This might include a deceased person\u2019s siblings or their parents, as it really will depend on who is still living at the time of the deceased person\u2019s death. If a person can show that they were financially dependent on the deceased person, then even these people listed below can bring a wrongful death lawsuit in California.<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-arrow-list\">\n<li><strong>The deceased person\u2019s parents<\/strong><\/li>\n\n\n\n<li><strong>Deceased person\u2019s stepkids<\/strong><\/li>\n\n\n\n<li><strong>The deceased person\u2019s \u201cputative spouse\u201d and the kids of the putative spouse<\/strong><\/li>\n<\/ul>\n\n<\/div><\/div>\n\n<div class=\"dklaw-toc__block align wp-block-dklaw-toc-block\"><div class=\"acf-innerblocks-container\">\n\n<h2 class=\"wp-block-heading\">How Long Is the Statute of Limitations in California for Wrongful Death?<\/h2>\n\n\n\n<p>Similar to personal injury claims, a wrongful death claim in California must be filed within a set amount of time, known as a statute of limitations. California law specifically requires that any wrongful death claim must be filed within 2 years of the date of the decedent\u2019s death.<\/p>\n\n\n\n<p>If a case is not filed in the California civil court system within 2 years, then the odds are the family will lose the right to file a claim at all.<\/p>\n\n<\/div><\/div>\n\n<div class=\"dklaw-toc__block align wp-block-dklaw-toc-block\"><div class=\"acf-innerblocks-container\">\n\n<h2 class=\"wp-block-heading\">Wrongful Death Statistics in California<\/h2>\n\n\n\n<p>In reality, California has a higher annual accidental death total than any other state.
