However, if they don\u2019t see another car or police officer, some will decide to risk cruising through the stop sign.&nbsp;<\/p>\n\n\n\n<p>This is a highly dangerous driving behavior that can lead to unforeseen accidents. There could be an approaching person riding an electric scooter or&nbsp;electric bike, a pedestrian, bicyclist, or another car that the driver cannot see. In a residential street, running stop signs can lead to major&nbsp;<a href=\"https:\/\/dklaw.com\/the-fine-print\/backing-out-of-a-driveway-accident\/\">accidents with vehicles backing out of a driveway<\/a>.<\/p>\n\n\n\n<p>There are <span style=\"margin: 0px; padding: 0px;\">nearly&nbsp;<a href=\"https:\/\/www.ncbi.nlm.nih.gov\/pubmed\/14733981\" target=\"_blank\">700,000 accidents each year<\/a>&nbsp;in the US involving a person running a stop sign, and approximately<\/span> 30% of those accidents result in injuries. The majority of these accidents and injuries could be avoided if people just followed the laws.&nbsp;<\/p>\n\n<\/div><\/div>\n\n<div class=\"dklaw-toc__block align wp-block-dklaw-toc-block\"><div class=\"acf-innerblocks-container\">\n\n<h2 class=\"wp-block-heading\">Common Injuries From Stop Sign Accidents<\/h2>\n\n\n\n<p>Most stop sign accidents happen when both drivers think they have the right of way. Additionally, another reason is that one driver was careless and failed to check that it was safe to proceed.<\/p>\n\n\n\n<p>Luckily, most of these accidents do not result in serious injuries. This is because the cars involved are either stopped or going at a very slow speed. However, a stop sign accident typically does result in some type of injury to whoever is hit.<\/p>\n\n\n\n<p>If the cars are driving slowly, the injuries are typically minor, like cuts and scratches. However, when a car is traveling at a higher speed, injuries become much more severe.<\/p>\n\n\n\n<p>These types of injuries include:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-arrow-list\">\n<li><strong>Whiplash<\/strong><\/li>\n\n\n\n<li><strong>Broken bones<\/strong><\/li>\n\n\n\n<li><strong>Wrongful death<\/strong><\/li>\n\n\n\n<li><strong>Brain injuries<\/strong><\/li>\n\n\n\n<li><strong>Concussion<\/strong><\/li>\n\n\n\n<li><strong>Lacerations<\/strong><\/li>\n<\/ul>\n\n<\/div><\/div>\n\n<div class=\"dklaw-toc__block align wp-block-dklaw-toc-block\"><div class=\"acf-innerblocks-container\">\n\n<h2 class=\"wp-block-heading\">Legal Liability for California Stop Sign Laws<\/h2>\n\n\n\n<p>More often than not, the driver without the right of way is responsible for stop sign accidents (but not always). California Vehicle Code 22450 VC states that drivers must stop at stop signs. Stop sign laws state:<\/p>\n\n\n<div class=\"dklaw-testimonials__testimonial dklaw-testimonials__testimonial-card align wp-block-dklaw-card-testimonial has-background has-primary-blue-background-color\" data-video-id=\"\"><div class=\"acf-innerblocks-container\">\n\n<h4 class=\"wp-block-heading has-primary-white-color has-text-color\">The driver of any vehicle approaching a stop sign at the entrance to, or within an intersection should stop at the limit line, if marked, otherwise before entering the crosswalk on the near side of the intersection. If there isn\u2019t a crosswalk line or limit line before the crosswalk, then the driver has to make a stop just before the beginning of the intersecting roadway.<br><\/h4>\n\n<\/div><\/div>\n<\/div><\/div>\n\n<div class=\"dklaw-toc__block align wp-block-dklaw-toc-block\"><div class=\"acf-innerblocks-container\">\n\n<h2 class=\"wp-block-heading\">California Stop Sign Laws &amp; Who Is at Fault<\/h2>\n\n\n\n<p>Each stop sign accident must be viewed as an isolated incident.<\/p>\n\n\n\n<p>This is why it\u2019s important to contact the authorities and file a police report. However, it\u2019s confusing for most to determine who is allowed to proceed first.<\/p>\n\n\n\n<p>If two vehicles come to an intersection at the same time, then the vehicle on the left must yield to the vehicle on the right.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Were You On a Through Street?<\/h3>\n\n\n\n<p>Another scenario is when one motorist stops but then proceeds without checking to make sure the path is clear to move forward.&nbsp;<\/p>\n\n\n\n<p>If you were driving on a through street, stopped at a stop sign, and then proceeded, you had the right-of-way. In this instance, it was the other driver\u2019s responsibility to stop until the road was clear.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Did You Run a Stop Sign?<\/h3>\n\n\n\n<p>If you were driving and you failed to stop at a stop sign, then you are going to be held accountable for the accident (at least to some degree). If the other driver clearly had the right-of-way, then you will be held completely liable.<\/p>\n\n\n\n<p>There are instances where you and the other driver could both be partially at fault. In this case, it will take time to determine liability. For instance, driving through a stop sign without coming to a complete stop is 100% a violation of traffic laws.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Is a Rolling Stop in California Legal?<\/h3>\n\n\n\n<p>The short answer is that a rolling stop is not legal. In addition, you are at risk of getting a ticket if you don\u2019t make a complete stop at a stop sign.<\/p>\n\n\n\n<p>Commonly referred to as a \u201cCalifornia Stop\u201d, it has become very common for all California drivers to stop for a few seconds and then proceed.
