Defined as illegally crossing the street without using a crosswalk, it could merit a hefty fine or citation. However, a new law passed in the most populous state in the US officially decriminalized jaywalking. So, what does this mean for pedestrians and drivers on the road?&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What Is the New Jaywalking Law?<\/h2>\n\n\n\n<p>Effective&nbsp;January 1st, 2023, the Freedom To Walk Act (<a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billNavClient.xhtml?bill_id=202120220AB2147\" target=\"_blank\" rel=\"noreferrer noopener\">AB 2147<\/a>) allows pedestrians to cross a street safely&nbsp;outside of a crosswalk or against a traffic light without fear of a ticket. Police officers can only ticket someone when there is \u201can immediate danger of a collision with a moving vehicle.\u201d <\/p>\n\n\n\n<p>The new law was introduced by San Francisco assembly member Phil Ting and passed into law by Governor Gavin Newsom. It applies to residential and non-residential areas.&nbsp;<\/p>\n\n<\/div><\/div>\n\n<div class=\"dklaw-toc__block align wp-block-dklaw-toc-block\"><div class=\"acf-innerblocks-container\">\n\n<h2 class=\"wp-block-heading\">Is Jaywalking Legal in California?<\/h2>\n\n\n\n<p>Technically, no. While the new law allows any reasonably careful person to jaywalk without fear of getting a ticket, jaywalking is still generally not legal. Pedestrians who do not cross safely or put themselves in immediate danger can still be fined by the local authorities.<\/p>\n\n\n\n<p>Previously, California adhered to strict jaywalking laws that had been the standard for nearly 100 years. In the early 1900s, the term \u201cjaywalking\u201d was introduced to denote pedestrians who ignored traffic signals. As California and the rest of the US became a car-dominated culture in the 20th century, the rules remained in place.&nbsp;<\/p>\n\n<\/div><\/div>\n\n<div class=\"dklaw-toc__block align wp-block-dklaw-toc-block\"><div class=\"acf-innerblocks-container\">\n\n<h2 class=\"wp-block-heading\">What Happens if I\u2019m Cited for Jaywalking?<\/h2>\n\n\n\n<p>Even with the current law, you can still be cited for dangerous jaywalking if you cross when it is not safe to do so. You will be subject to an infraction and a fine, but no points will be added to your personal record.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Can You Get a Ticket for Jaywalking?<\/h3>\n\n\n\n<p>Yes. The new law protects pedestrians from most jaywalking tickets, but not all. For example, if you cross a busy street with oncoming traffic, a police officer can give you a ticket. You can pay the fine online, by mail, or in person at your county\u2019s district court.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">What Is the Fine for Jaywalking?<\/h3>\n\n\n\n<p>A standard jaywalking infraction carries a fine of up to $250; however, that amount could vary due to state-mandated fees and assessments.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Can You Get Arrested for Jaywalking?<\/h3>\n\n\n\n<p>In California, crimes are defined as infractions, misdemeanors, and felonies. An infraction is considered the least serious of the three and does not warrant an arrest. Since jaywalking is considered an infraction, you would not be arrested. Other examples of traffic infractions include speeding, making an illegal U-turn, and running a red light. Misdemeanors and felonies are considered more serious and dangerous crimes and can result in criminal charges and jail time.<\/p>\n\n<\/div><\/div>\n\n<div class=\"dklaw-toc__block align wp-block-dklaw-toc-block\"><div class=\"acf-innerblocks-container\">\n\n<h2 class=\"wp-block-heading\">How to Stay Safe<\/h2>\n\n\n\n<p>According to data from the&nbsp;<a href=\"https:\/\/www.ghsa.org\/news\/early-2024-us-pedestrian-fatalities-48-decade-ago\" target=\"_blank\" rel=\"noreferrer noopener\">Governors Highway Safety Association<\/a>, there were 3,304 pedestrian deaths in the first half of 2024 \u2013 a 48% increase from a decade ago. It is imperative that drivers and pedestrians follow safe practices to avoid an accident and serious injury. Here are some safety tips to protect pedestrians and drivers:&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Safety tips for drivers:<\/h3>\n\n\n\n<ul class=\"wp-block-list is-style-arrow-list\">\n<li>Always yield to pedestrians at crosswalks and intersections. They have the right-of-way.<\/li>\n\n\n\n<li>Follow the speed limit and slow down when turning or approaching a crosswalk.<\/li>\n\n\n\n<li>Avoid distractions while driving \u2013 texting, emailing, eating, or changing the radio.<\/li>\n\n\n\n<li>Be extra cautious when making left turns.<\/li>\n\n\n\n<li>Never drive while under the influence.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Safety tips for pedestrians:<\/h3>\n\n\n\n<ul class=\"wp-block-list is-style-arrow-list\">\n<li>Look left-right-left before crossing.&nbsp;<\/li>\n\n\n\n<li>Use crosswalks when available, especially at busy intersections.<\/li>\n\n\n\n<li>Make eye contact with the driver when crossing.<\/li>\n\n\n\n<li>Walk on sidewalks when available.
