Since January 1, 2025, under SB 1107, those are $30,000 for injury to one person, $60,000 for injury to everyone in one crash, and $15,000 for property damage.

The third number is the one that pays for your car. It does not share a pot with the first two. A crash that exhausts the $15,000 property damage limit leaves the $30,000 and $60,000 bodily injury limits untouched, and the reverse is equally true.

In practice, the two claims are usually handled by different adjusters, sometimes in different departments, on different timelines.

What does property damage liability actually cover?

It covers damage the policyholder causes to someone else’s property. It never covers the policyholder’s own car.

This is a common misunderstanding. Suppose Driver A rear-ends Driver B. A’s property damage liability coverage pays to fix B’s car. If A’s own car is wrecked in the same crash, that coverage does nothing for it.

For A’s own vehicle, A needs collision coverage, which is first-party coverage that pays regardless of fault and is subject to a deductible. Someone carrying California’s minimum liability policy and nothing else has no coverage for their own car at all.

Who pays for my car, the other driver’s insurance or mine?

There are usually three routes, and they trade speed against cost.

The at-fault driver’s property damage liability coverage is the cleanest outcome. No deductible, and the full cost comes from the person who caused it. The drawback is that nothing moves until that insurer accepts liability, which can take weeks when fault is contested.

Your own collision coverage is the fast route. You pay your deductible, your insurer pays the repair, and your insurer then pursues the at-fault carrier through subrogation. When it recovers, it typically returns your deductible in proportion to what it collects. That subrogation payment comes out of the at-fault driver’s property damage limit, not the bodily injury limit.

If the other driver has no insurance, uninsured motorist property damage coverage may apply, if you carry it. It is optional in California, and many people do not have it.

How much is my car worth if it is totaled?

The settlement should cover more than the car’s base value.

Title 10, section 2695.8 of the California Code of Regulations sets what a total loss settlement has to include: the actual cost of a comparable automobile (less your deductible if the claim is under your own policy), plus applicable taxes, one-time license and transfer fees, and the license fee and other annual fees computed on the remaining term of the loss vehicle’s current registration.

The prorated registration and the sales tax are the items that get left on the table. If you paid for twelve months of registration and the car was destroyed in month three, nine months of that belongs to you.

The same regulation governs the comparables the insurer uses. Each one has to be identified by vehicle identification number, dealer stock number, or license plate, along with the seller’s telephone number or address. Deductions that cannot be supported are not permitted, and the insurer cannot deduct for condition unless the documented condition is below average.

California does not set a fixed percentage of value that makes a car a total loss, so be cautious of any page that says it does.

If you keep the vehicle, the sales tax is adjusted for the salvage value, the insurer has to tell you about the DMV salvage notice requirement, and you are entitled to a refund of unused license fees.

Can I get money for my car being worth less after it is repaired?

Sometimes, and the answer depends on who you are claiming against.

CACI 3903J spells out the measure. Where a vehicle can be repaired but will be worth less afterward than it was before, the damages are the difference between its value immediately before the harm and its lesser value after the repairs, plus the reasonable cost of making the repairs, with the total capped at the vehicle’s value immediately before the crash. The rule traces to Merchant Shippers Assn. v. Kellogg Express & Draying Co.

Kimes v. Grosser puts the burden in a useful place. The cost of repairs is a prima facie measure of damages, and it falls to the defendant to come forward with proof of a lesser diminution in value.

The honest limit: this works against the at-fault driver’s liability coverage. It usually does not work against your own collision coverage, because a first-party policy can limit the insurer’s obligation to repairing or paying for the vehicle, which is what the court addressed in Baldwin v. AAA Northern California.

Be cautious of any page that cites a standard California diminished value formula. California law does not set one.

Who pays for a rental while my car is being repaired?

CACI 3903M sets the measure as the reasonable cost to rent a similar vehicle for the time reasonably necessary to repair or replace it. The instruction applies whether the vehicle was damaged or destroyed, and the measure is rental value whether or not you actually rented something.

This is a damages element you claim, not a service the other insurer is obligated to arrange. In practice, many at-fault carriers will set up a rental once liability is accepted, and many will argue about how long is reasonable.

Can the insurance company make me use their body shop?

No. Insurance Code section 758.5 provides that no insurer shall require that an automobile be repaired at a specific automotive repair dealer.

An insurer can suggest or recommend a shop in two situations: when you expressly ask for a referral, or when you have been informed in writing of your right to select the repair dealer. The required written notice has to state, in plain print, that the insurer is prohibited by law from requiring that repairs be done at a specific automotive repair dealer and that you are entitled to select the auto body shop.

The claims regulations reinforce it. Once you have told the insurer which shop you want, it cannot suggest or recommend that you choose a different one.

How long do I have to file?

This is where the two claims separate, and it is a detail that can cause serious problems.

A claim for injury to your vehicle falls under Code of Civil Procedure section 338(c), which gives three years. A claim for your bodily injuries falls under section 335.1, which gives two.

Settling the car claim in month two does nothing to extend the injury deadline. The clocks run separately. A claim against a public entity collapses both into a six-month claim-filing deadline.

Should I sign the release that comes with the property damage check?

Only if it covers your car and nothing else.

Insurers sometimes attach a broad release to a property damage payment. Sign the broad version, and you can give up the injury claim at the same time, including injuries you have not noticed yet. Neck and back injuries often take days or weeks to show up.

California law offers some protection. Civil Code section 1542 says a general release does not extend to claims you do not know or suspect exist when you sign it, if knowing about them would have materially affected your settlement. In Casey v. Proctor, a driver signed a release after negotiations about his car, and the California Supreme Court held that a jury could decide whether he knowingly released injuries he did not yet know about.

You can waive that protection, and some insurance releases include language that does. Courts generally enforce those waivers, which means signing one can give up claims you do not yet know you have.

The words known and unknown

Any mention of Civil Code section 1542

A release of all persons rather than the driver who hit you

Any mention of bodily injury on a form that is supposed to be about your car

A release that names your vehicle and the repair or total loss amount is routine, and signing it is normal. One that reaches further is a different document with the same title. Ask someone before you sign that one.

How does the property damage claim fit into my injury settlement?

They are two separate claims, settled at different times, paid out of different limits.

The car claim usually closes within weeks. The injury claim stays open until you finish treatment, because an injury that is still changing cannot be valued yet. Settling the car does not speed up the injury claim and does not slow it down.

When the injury claim settles, the money you already received for your vehicle is not part of that number. It came out of the property damage limit, and it is done. The injury settlement is built separately from medical expenses, lost earnings, lost earning capacity, and non-economic losses, and it is paid from the bodily injury limits.

One thing does carry across, and it is the release. A property damage release limited to your vehicle leaves the injury claim where it was. A broad one can end that claim before anyone has worked out what it is worth.

Do I have to report the crash to the DMV?

Yes, if property damage to any one person exceeds $1,000, or if anyone was injured or killed. The report is Form SR-1; it is due within 10 days, and it is required under Vehicle Code section 16000. Failure to file can lead to suspension of your driving privilege.

That threshold is low enough that most collisions involving any visible damage clear it.

Does a lawyer take a fee on my property damage?

Often not. A contingency fee typically applies to the injury recovery, and many firms do not take a fee on the property damage portion. Check your fee agreement.

Most personal injury firms will help with the vehicle claim as part of handling the case, without charging for it. Whatever a firm tells you about fees, ask to see where it is written in the fee agreement before you sign.

The reason to involve a lawyer in a property damage claim is rarely the money in it. It is the release, the deadline, and keeping the car claim from quietly closing the injury claim along with it.

If you were hurt in a car accident in California and want to understand where your claim stands, call DK Law for a free consultation.

About the Author

Elvis Goren

Elvis Goren is the Organic Growth Manager at DK Law, bringing over a decade of content and SEO expertise from Silicon Valley startups to the legal industry.
