Even the most experienced and careful drivers can encounter road hazards that can jeopardize their safety and that of others. Road hazards can be natural, such as weather or animals, or man-made, such as debris, uneven expansion joints, or potholes.

Recognizing the most frequent road hazards is the first step in preventing injuries on the road. By following these tips, you can reduce your chances of getting into a car accident and enjoy a safer ride.

    Potholes

Potholes are one of the most common and dangerous road hazards in California. They can be caused by a variety of factors, including heavy storms, traffic, and poor road construction. Potholes can result in a tire blowout or damage your car’s suspension and alignment. To avoid pothole damage, drivers should:

    • Report any potholes to your city’s public works department
    • If possible, avoid driving over potholes, or drive slowly and carefully over them if they cannot be avoided. Hold the steering wheel firmly.

    Construction Zones

While construction zones aim to improve roadway safety, they can also pose a risk to drivers and workers. Lane closures, detours, and moving equipment can cause confusion and result in accidents. According to the National Safety Council, over 100 road construction workers are killed in construction zones every year. To avoid construction site hazards, drivers should:

    • Pay attention to the signs and signals on the road and follow them accordingly.
    • Slow down and obey the speed limit in the construction zone.
    • Keep a safe distance from the vehicle in front and avoid changing lanes or passing.
    • Be patient and respectful of the workers and other drivers.

    Slick Surfaces

Snow, ice, sleet, rainwater, and oil spills can create an environment that is dangerous for all types of motorists. When the roads are slick or slippery, they can lead to vehicles sliding or hydroplaning, which can result in a driver losing control.  Motorcyclists are especially vulnerable in slippery road conditions, as they lack the stability of larger vehicles. To avoid a collision, drivers should:

    • Limit driving in bad weather conditions.
    • Purchase snow tires if you live in a cold climate.
    • Drive slower and do not brake suddenly if you encounter slick or slippery roads.

    Careless Pedestrians Bicyclists

Pedestrians and cyclists can be potential road hazards if they fail to respect the rules of the road. Pedestrians should use a crosswalk when available and wait until the Walk sign is on. If they are walking at night, they should wear white or bright clothing to be easily seen. Cyclists are considered the same as motor vehicles on the road, which means they must obey most of the same rules. To avoid a collision with a pedestrian or cyclist, drivers should:

    • Keep a safe distance from bicyclists on the road (at least 3 feet).
    • Always give pedestrians the right of way at marked and unmarked crosswalks.
    • Yield to pedestrians and cyclists when turning.

    Heavy Traffic

California has some of the most congested roads in the country, especially in cities like Los Angeles, San Francisco, and San Diego. Heavy traffic can increase risky and dangerous behaviors like unsafe lane changes, road rage, and stress. Heavy traffic can also lead to rear-end collisions when drivers become distracted or tailgate. To avoid traffic accidents, drivers should:

    • Plan ahead and check the traffic conditions before driving.
    • Carpool or use alternative routes if possible.
    • Avoid driving during rush hours or special events that may cause traffic jams.
    • Drive defensively and respect the rules of the road.

    Animals

Animals like deer, coyotes, and raccoons can be a major hazard on California roads. While unusual, these can cause serious accidents if they cross the road unexpectedly. Animal collisions are most common during dawn and dusk, when animals are more active and visibility is low. To avoid animal collisions, drivers should:

    • Slow down and scan the road ahead for any signs of movement.
    • Use high beams when possible to increase visibility.
    • Avoid swerving if an animal is in the road. Doing so can cause a loss of control or a collision with another vehicle or object.

    Faulty Traffic Lights

When driving, it’s common to come across a faulty traffic light. Traffic light malfunctions can happen from power surges or outages that may take hours or days to repair. This type of road hazard can lead to collisions because drivers may become confused or run red lights. If a traffic light is malfunctioning, drivers should:

    • Proceed with caution and be alert for other vehicles and pedestrians.
    • Treat the intersection as a four-way stop. Stop before entering the intersection and proceed in the order of arrival.

    Blind Curves

A blind curve is a bend in the road where a driver cannot see oncoming traffic. It is a dangerous road hazard that can result in head-on collisions and rear-end accidents with the potential for serious injury. Blind curves can be found on all types of roads, but are especially dangerous on country roads. Animals, cyclists, and pedestrians may be present in the roadway. To avoid blind curve car accidents, drivers should:

    • Pay attention to signs or markings that indicate a blind curve ahead.
    • Moderate your speed and do not attempt to speed in front of an oncoming vehicle.
    • Use the horn or headlights to warn other drivers of your presence.
    • Keep to the right side of the lane and avoid crossing the centerline.

    Semis and Large Trucks

Large commercial vehicles create hazards for drivers due to their large size, weight, blind spots, and longer stopping distance. Semis and large trucks can also cause wind gusts that can affect the stability of smaller vehicles. To avoid semis and large truck hazards, drivers should:

    • Give them plenty of space and avoid driving in their blind spots.
    • Pass them quickly and safely and do not cut in front of them, as they need more time and distance to brake.
    • Be cautious when driving behind or beside them, as they may make wide turns or sway in their lanes.

    다른 운전자의 과실

Yes, it’s obvious. But the greatest threat to roadway safety is other drivers. On average, there are over 6 million car accidents in the U.S. That is one car accident every 10 seconds.

Sometimes car accidents are unavoidable, but most are largely preventable. Factors such as speeding, distracted driving, and drunk driving can all be avoided. One of the most important things a driver can do is drive defensively. This means always being prepared for the unexpected. To avoid a car accident with another driver, you should:

    • Leave plenty of space between you and the car in front of you. Don’t tailgate!
    • Be aware of blind spots when merging or switching lanes.
    • Stay out of the left lane unless you need to pass a slower vehicle
    • Don’t drive drunk or distracted.

    Road Hazards: Who Is Liable?

Determining who is liable for a roadway hazard can be complicated and depends on the type and source of the hazard. In some cases, the government entity responsible for maintaining and repairing the roads may be liable. Still, you must prove they were aware of the hazard and neglected to fix it within a reasonable amount of time. In other cases, private entities such as construction companies or truck drivers may be liable for creating or leaving behind a roadway hazard.

California is a pure comparative negligence state. This means that an injured victim can still recover damages from another party who is at fault, even if they are also partially at fault. The amount of damages is reduced by the percentage of fault of the injured person. For example, if a person is 40% at fault for an accident and suffers $100,000 in damages, they can still recover $60,000 from the other party who is 60% at fault. Getting into a car accident is scary and stressful. It can also be incredibly confusing when another driver didn’t cause your accident, but by a road hazard. If you were in an accident due to unsafe road conditions, you shouldn’t assume you don’t have a case. Our personal injury lawyers have years of experience representing clients after an auto accident.

Even if another driver’s negligence didn’t cause your accident, the city or government could be responsible for your accident if they failed to properly maintain the roads. Contact DK Law for a free consultation today!
