Los Angeles Burn Injury Lawyer
DK Law represents burn injury victims across Los Angeles. Burn cases turn on two questions faster than most injury cases do: what caused the burn, and who owned or made the thing that caused it. The answer changes who you can hold responsible and, in one situation people miss entirely, how long you have to act.

Quick Answers
- Cost to you: nothing up front. We work on contingency. No fee unless we recover money for you.
- If a defective product burned you, you do not have to prove the maker was careless. California law only requires that the product was defective and that the defect caused your injury.
- If a utility was involved, find out which one immediately. A claim involving the Los Angeles Department of Water and Power, which is a city department, may have to be filed within six months. Southern California Edison is a private company, so the normal two years applies.
- A missing or dead smoke alarm is evidence. California requires landlords to install and maintain working alarms.
- Burned at work? You may have a second claim against someone other than your employer, and it is often worth far more than workers’ comp.
- The lungs are often the bigger injury. Breathing smoke or hot gases can be life-threatening even when the skin burns look small.

What Caused Your Burn? It Changes Who’s Responsible
Defective Products
California law doesn’t require you to prove a manufacturer was careless or knew about a defect. Under a legal standard known as strict liability, you only need to show that the product was defective and that the defect caused your injury.
A product can be considered defective in one of two ways:
- It failed to perform as safely as an ordinary user would expect, or
- Its risks outweigh its benefits
Lithium-ion batteries are one of the most common sources of these claims today. In 2025, the Consumer Product Safety Commission recalled roughly 1.1 million Anker power banks after fire and explosion reports, and has since issued warnings on e-bike batteries and other chargers. Pressure cookers, space heaters, and vehicle components can lead to similar claims.
A Landlord’s Building
California law requires smoke alarms in every rental unit, and landlords are responsible for making sure they work, both at the start of a tenancy and throughout it. Carbon monoxide alarms are also required in units with a gas appliance, fireplace, or attached garage.
Landlords also have a legal duty to keep a rental home safe and livable. A dead smoke alarm, exposed wiring, a blocked exit, or an ignored complaint about a gas smell can all be signs of negligence. If this applies to your situation, your complaint history with the landlord is usually one of the first things we’ll want to review.
A Utility Company
Before anything else, it’s important to find out which utility served the property, because the deadline to file a claim depends entirely on the answer.
- A public utility (like the Los Angeles Department of Water and Power) is part of a government agency. Claims against it must be filed within six months of the injury
- A private utility (like Southern California Edison) follows the standard two-year deadline
Two nearly identical injuries can have deadlines eighteen months apart, simply based on which utility was involved. This is one of the first things we help confirm.
A Workplace Injury
If you were burned at work, workers’ compensation generally covers your medical care regardless of fault, but in exchange, you typically can’t sue your employer directly.
However, you may have a second, separate claim against someone other than your employer, such as:
- The manufacturer of equipment that failed (a fryer, boiler, pressure vessel, or heater)
- A contractor who controlled the worksite
- A chemical supplier
This matters because workers’ comp doesn’t cover pain and suffering and doesn’t replace your full lost income, which is often why this second claim ends up being worth more.
How Doctors Measure a Burn, and What It Means for Your Case
Burn Depth (“Degree”)
Two numbers drive everything about a burn injury: how deep it goes, and how much of the body it covers.
- First degree — Affects only the top layer of skin (like a sunburn) and heals on its own
- Second degree — Goes deeper, causes blistering, and is very painful
- Third degree — Destroys all layers of skin. May look leathery or feel numb, since the nerves are damaged
- Fourth degree — Reaches muscle, tendon, or bone
Second-degree burns and deeper usually mean scarring, and often require skin grafts, a procedure where surgeons move healthy skin to cover the wound.
Burn Coverage (% of the Body)
Coverage is measured as a percentage of the body, counting only second-degree burns and deeper. Emergency staff estimates this quickly using a method that assigns roughly:
- 9% to each major body region
- 1% to the palm of the hand
Why These Numbers Matter
Together, depth and coverage determine whether a burn should be treated at a specialized burn center. The American Burn Association recommends transfer for:
- Second-degree burns covering more than 10% of the body
- Any third-degree burn
- Any burn to the face, hands, feet, or genitals
- All electrical, chemical, and inhalation injuries
Meeting any of these criteria is itself a sign the injury is serious.
Two Things Insurers Often Understate
- Inhalation injury — Damage to the airway and lungs from smoke or hot gases. This is often what makes a fire case catastrophic, more than the skin injury itself
- Electrical burns — These can look far smaller than they actually are, since electrical current travels through the body and damages muscle, nerves, and organs along the way
Over time, scar tissue can tighten across a joint and limit movement, which is why burn treatment often involves repeated surgeries rather than just one.
This is general information, not medical or legal advice. For care, see a licensed medical professional.

What DK Law Does for Your Case
- Finds and preserves the thing that caused the burn. A defective appliance, heater, battery, or piece of equipment is the case. It gets thrown away or repaired within days if nobody moves fast.
- Pulls the fire investigation. Fire department origin-and-cause reports, building permits, inspection history, and code violation records.
- Identifies every responsible party, which, in burn cases, is often more than one: a manufacturer, a property owner, a contractor, and a utility can all be involved.
- Documents what the injury will cost over a lifetime, including the reconstructive surgeries that come years later. Our catastrophic injury page explains how that gets calculated.
- Handles the insurance companies so the adjusters stop calling you.
- Files against public agencies on time, because that six-month deadline is unforgiving.
How Long Do You Have to File?
- Against a person or company: two years from the date of injury.
- Against the City of Los Angeles, LADWP, the County, or a state agency: generally six months, and a written claim must be filed.
- Workers’ comp has its own separate deadlines, and filing for it does not extend the deadlines above.
