    Los Angeles Bus Accident Lawyer

DK Law represents people hurt in bus crashes across Los Angeles. Metro buses, DASH and Commuter Express, Big Blue Bus, school buses, charter and tour buses, and airport shuttles. The consultation is free, and there is no fee unless we win your case.

If you were riding the bus, California holds the operator to an unusually high standard of care. If you were walking, cycling, or driving and a bus hit you, the standard drops to ordinary negligence.

Same crash, same driver, two different cases.

    빠른 답변

    • What it costs to ask: Nothing. We work on contingency, so there’s no fee unless we recover for you.
    • Passengers get the stronger standard. California requires carriers to use the utmost care and diligence for the safety of the people riding.
    • Everyone else gets ordinary negligence, the same standard that applies to any driver on the road.
    • Public buses come with a six-month deadline. Metro, City of LA services, Santa Monica, LAUSD, and the airport shuttle are all public entities.
    • Charter and tour buses are private, which means two years and federally required insurance that is often substantial.
    • Punitive damages aren’t available against a public agency in California. Compensatory damages are.

Were You on the Bus or Hit by It?

California treats a bus company as a common carrier, and the law requires a carrier of passengers to use the utmost care and diligence for their safe carriage. The California Supreme Court confirmed in Lopez v. Southern California Rapid Transit District that a public transit district owes its passengers that same heightened duty.

What that means practically: a bus driver’s conduct gets measured against the highest degree of care that’s realistic for running a bus, rather than against what a reasonable person would do.

If you weren’t a passenger, that higher standard doesn’t apply to you. A pedestrian in a crosswalk, a cyclist in a bike lane, or another motorist gets ordinary negligence, exactly the same standard that would apply if a private car had hit them. You can still recover fully. You just have a slightly harder case to build.

Where the line falls matters. The passenger relationship generally starts when you’re boarding and continues through getting off. Someone waiting at a stop, or already walked away from the bus, is usually outside it. If your injury happened during boarding or exiting, say so early, because it may change which standard applies to your case.

    핵심 요약

    • Riding the bus gets you the utmost care standard. Being hit by one gets you ordinary negligence. Where you were standing changes the case.
    • Nearly every bus in Los Angeles that isn’t a charter is run by a public entity, which means a six-month claim deadline and a second six-month window after rejection.
    • A DASH claim usually involves both the City of Los Angeles and the private company operating the route.
    • School bus cases often turn on a specific written rule about red lights and escorting students, which is easier to prove than a general negligence argument.
    • Charter operators carry federally required insurance of $5 million or more and generate safety records you can obtain in litigation.

Injuries We See in Bus Cases

Buses are heavy, most passengers are unrestrained, and pedestrians struck by one have nothing between them and several tons of vehicle. The pattern reflects that:

    • Head and brain injuries, from being thrown against a seat back, a stanchion, or the floor. Standing passengers take the worst of this.
    • Spinal cord injuries, including the catastrophic ones where the case becomes about a lifetime of care rather than a course of treatment.
    • Crush injuries and amputations, most often in pedestrian and cyclist collisions involving a turning bus.
    • Broken bones and internal injuries, which are the most common outcome for seated passengers in a hard impact.
    • Psychological injury, including PTSD after a serious crash, which is compensable and routinely left out of a claim by people who assume it doesn’t count.

What DK Law Does for Your Case

    • We work out who actually operated the bus, which is less obvious than it sounds. A DASH bus is a City of Los Angeles service, but the City contracts the day-to-day operation to a private company. Both facts matter to who gets named.
    • We file the government claim on time and in the right form, because a public entity claim that arrives late or in the wrong channel is worth nothing regardless of how strong the case underneath it is.
    • We request the onboard and station video immediately. Transit video runs on overwrite cycles measured in days or weeks. A request sent in month three often finds nothing left.
    • We pull the driver and vehicle history, including training records, hours worked, prior complaints, and maintenance logs. For charter operators, there are federal safety records available that most people don’t know exist.
    • We gather evidence and consult experts to reconstruct what happened, and we handle the medical billing and lien side so you can focus on treatment rather than paperwork.

    How Long Do You Have?

If a public agency operated the bus, California’s government claims statute gives you six months from the injury to present a written claim. You cannot sue until you’ve done it.

After the agency rejects the claim in writing, a second clock starts, and you generally have six more months to actually file suit. That compressed second window surprises almost everyone.

For a private charter or tour operator, the ordinary 2년 기한 applies, and there’s no claim to present first.

    Who Do You Actually Sue?

OperatorWhat it is legallyDeadlineWho you name
Metro busLACMTA, a public entitySix monthsLACMTA, by mail or in person
DASH / Commuter ExpressA City of LA service run by a private contract operatorSix monthsThe City of Los Angeles, and usually the contractor too
Big Blue BusCity of Santa MonicaSix monthsCity of Santa Monica
LAX FlyAwayLos Angeles World Airports, a City departmentSix monthsCity of LA / LAWA
School busThe school district, a public entitySix monthsThe district
Culver CityBus, Foothill, Torrance, Montebello, NorwalkMunicipal or regional public agenciesSix monthsThe city or authority
Charter, tour, or shuttleA private, state-licensed carrierTwo yearsThe company, and often its insurer directly

The DASH row is the one that trips people up. Riders assume they’re dealing with the City, and they are, but the driver works for a contractor. Getting both parties into the claim is part of the job.

The same structure applies to LAX FlyAway: LAWA manages the service as a City department, but the buses themselves are run by contracted operators, so a claim here often needs to name both the City and the operating company, not just one or the other.

Can You Sue LA Metro or the City?

Yes. Public agencies are liable for the negligence of their employees acting on the job, and they’re liable for dangerous conditions on property they control, which can cover a badly designed stop or a hazardous boarding area.

The one real limit: California bars punitive damages against public entities. Medical costs, lost income, future care, and pain and suffering all remain recoverable. Punitive damages do not.

아래 Government Code section 818, public entities like a city, county, school district, or transit authority can’t be ordered to pay punitive damages, no matter how reckless their conduct was. But compensatory damages remain fully available: medical expenses, lost income, future care, and pain and suffering can all still be recovered.

What if It Was a School Bus?

School districts are public entities, so the six-month claim deadline applies. What’s different is the duty owed to children, which courts treat as heightened, and the specific rules the driver has to follow.

캘리포니아의 school bus law requires the driver to activate the flashing red lights and stop arm before students cross. For younger students, the driver has to get out and escort them across the road with a hand-held stop sign.

When a driver skips that step and a child gets hit, the case rests on a specific written rule rather than a judgment call about what was reasonable.

What if It Was a Charter or Tour Bus?

Private buses run on different rules, and several of them work in an injured passenger’s favor.

    • Two years to file, with no government claim requirement in front of it.
    • Federally mandated insurance. Carriers running vehicles with 16 or more seats must carry at least $5 million in coverage, and smaller vehicles at least $1.5 million. Coverage is rarely the limiting factor.
    • A paper trail you can subpoena, including driver hours of service, drug and alcohol testing, vehicle inspections, and maintenance records, all federally required.
    • State licensing on top of that. Charter operators in California need a permit from the Public Utilities Commission, and operating without one is itself evidence about how the company runs.
    • Punitive damages are available, unlike claims against a public agency, where the conduct supports them.
