The Real Story: What People Think About
PI Attorneys vs. Insurance Companies
When you’re hurt after a crash, the questions hit fast: Do I need a lawyer? Can I trust insurance? What will this cost?
To get real answers, DK Law surveyed accident victims nationwide. Their responses reveal what holds people back — and the clearer path forward.

Most people don’t wait because they’re stubborn – they wait because they don’t know what to do.

Method in Brief
- Who : 2,000 U.S. adults who reported experiencing an accident or injury
- What : Attitudes toward attorneys vs insurers, decision triggers, satisfaction
- How : Online survey; screened for relevance; responses de-duplicated
- When: Fieldwork for the survey began on June 12 and ended on June 27, 2025
- Why it matters : Real perceptions from real accident victims
When it comes to accidents and injuries, many people are unsure who to trust, what to expect, and whether hiring a personal injury attorney is worth it.
To cut through the confusion, we conducted a nationwide survey of accident victims to find out what they really think. We asked what made them hesitate to hire an attorney, what finally convinced them to take that step, and how they felt afterward.
Here’s what we found.
Key Takeaways
- Motor vehicle accidents drive most legal decisions: Among those who hired an attorney, 67.5% were involved in a vehicle-related crash.
- Clients are overwhelmingly satisfied: 73% rated working with a personal injury attorney as “somewhat easy” or “very easy,” and 90% said they would hire one again.
- Insurance skepticism is strong: Only 11% believe insurance companies act in their best interest, compared to 48% who trust their personal injury attorney.
- Knowledge gaps persist: Among those who didn’t hire an attorney, 28% didn’t know it was an option, and 23% assumed it would cost too much (even though most personal injury attorneys work on contingency).
Who Seeks Legal Help After an Accident?
Shockingly, nearly 70% of accident victims take no formal action at all. For those who do:
- 67.5% were involved in motor vehicle accidents
- 25.5% in workplace injuries
- 12.5% in product liability cases
- 12% in medical malpractice cases
- 11.5% in premises liability incidents
- 11% in injuries caused by property damage
- 4% in family member wrongful death claims
This data suggests that people are most likely to seek legal help after high-impact events such as car crashes or serious workplace accidents.
Minor injuries often go unrepresented, leaving victims at a disadvantage.

Why Many Accident Victims Hesitate to Hire an Attorney
The misconception of “not serious enough”
When prompted why they didn’t hire an attorney, 32.9% of those surveyed felt their case “wasn’t serious enough.” This is very common in personal injury – often, many believe that hiring a lawyer means suffering a catastrophic injury, like a TBI. But even injuries like whiplash, often dismissed as minor, can lead to chronic pain.
Another 23% worried that hiring a lawyer would cost too much. In reality, most consultations are free, and attorneys work on a contingency basis, meaning you pay nothing unless you win.
The survey results reveal that many of these concerns stem from misconceptions about personal injury law.
The truth about cost and contingency fees
A major blocker is price confusion. Most personal injury firms, including DK Law, offer free consultations and work on contingency (you don’t pay attorney’s fees unless we recover compensation). Cost shouldn’t keep you from learning your options.
Insurers vs. Attorneys – Perception vs. Reality
Why trust in insurers is fragile
While many people sense that insurance companies prioritize profit over fairness, not everyone understands how far those strategies can go. Our respondents reported frustration with confusing processes and mixed messages – especially when early statements were recorded before injuries were fully documented.
On the topic of insurance companies, our survey found that:
- Only 11% believe insurance companies act in the best interest of customers
- 38.3% were unaware of tactics like the “delay, deny, defend” approach commonly used by insurers
- Many respondents expressed frustration at insurance ads that paint companies as caring, when real experiences suggest otherwise
How people see personal injury attorneys
Whether you’re driving through Los Angeles, Las Vegas, or Nashville, personal injury billboards and TV ads are hard to miss.
Survey participants had mixed reactions to this visibility. Some found the frequency of billboards and commercials overwhelming or off-putting, while others said the advertising made them feel more informed about their options.
For those who sought legal help, many reported that simply knowing attorneys were accessible, whether through ads, referrals, or online research, gave them the confidence to explore their options. The data suggests that awareness of available legal services, regardless of the source, can reduce hesitation when people are deciding whether to reach out.
Survey Insights: Who Turns to Legal Support
Demographics of our survey respondents
- Income: A significant portion of respondents – those earning $50,000 to $74,000 per year – reported hiring an attorney, showing that middle-income earners are actively seeking legal guidance.
- Race / Ethnicity: 73.5% of respondents identified as White, providing insight into the communities most represented in our survey.
- Age: The average age of respondents was 51, reflecting a broad mix of adults who had experienced accidents in work, home, and travel contexts.
- Gender: Among those surveyed, 60% were female, and 40% were male, with women slightly more likely to seek legal guidance after minor injuries.
Satisfaction among those who hired an attorney
Among respondents who worked with an attorney:
- 43.5% were very satisfied with their attorney
- 60% had their cases settle out of court
- 40% were very satisfied with both the outcome and the ease of working with their lawyer
- 90% said they would hire an attorney again
Respondents reported higher satisfaction and greater confidence when working with attorneys rather than navigating insurers alone.
What Changes When You Seek Legal Help
Your medical timeline can impact your case timeline
Seeing a doctor within 24–48 hours, noting all symptoms, and following care recommendations helps establish a factual foundation. Even injuries that seem minor can sometimes require ongoing treatment.
Simple ways to preserve evidence
Keeping basic documentation – photos (wide and close), street signs, witness contacts, and a short daily log (pain levels, missed work, sleep limitations) – can make a measurable difference in supporting your case.
Mini case snapshots (examples)
Disclaimer: The case snapshots below are hypothetical examples created for educational purposes to illustrate common patterns we see, not actual client cases.
- Case A: The wait-and-see approach: A rear-end accident victim “felt fine” and delayed care. Weeks later, severe neck pain developed. Missing early medical records made it harder to connect the injury to the accident, complicating treatment approvals and the claims process.
- Case B: Early documentation makes a difference: Another driver sought medical care within 24 hours and kept detailed records of symptoms and treatment. While outcomes vary case by case, early documentation helped establish a clear timeline that supported their claim during negotiations.
The takeaway: Whether your case settles quickly or takes longer, documenting injuries early gives you more options and helps protect your interests throughout the process.
