What Are California’s Speed Limit Laws?

In California, speed limit laws require drivers to travel at a “reasonable and prudent” speed for road conditions, even if below posted limits. Generally, the speed limit is 65 mph on multi‑lane freeways, 55 mph on two‑lane highways or when towing, and reduced speeds (15–25 mph) in alleys, school zones, and residential areas.
Who Can Use the Carpool Lanes in California?
California’s carpool (HOV) lanes—often called diamond lanes—help ease congestion and promote cleaner transportation. In Southern California, these lanes operate 24/7, while in Northern California, they’re enforced only during weekday peak hours (typically mornings and evenings). Eligible users include vehicles with two or more occupants, motorcycles, mass transit, and designated clean-air vehicles with DMV-issued decals. Entering and exiting is only permitted across dashed lines—crossing solid double lines can result in fines that typically start around $490 and vary by county.
California’s Comparative Fault Laws
California follows the pure comparative negligence rule. Under this rule, a plaintiff can recover damages even if they are 99% at fault for the accident. The plaintiff’s recovery is reduced by their percentage of fault. For example, if the plaintiff is 90% at fault and the defendant is 10% at fault, the plaintiff can still recover 10% of their damages. This law attempts to resolve issues of fault when multiple parties are involved, like in a multi-vehicle collision. Currently, there are 13 pure comparative fault states.

- Motorcycle deaths rose 3.8% to 634 in 2022, with helmetless deaths increasing by 11%.
- Bicycle fatalities surged 32.1%, from 134 to 177 in 2022.
- I‑15 (Exit 138–129) saw 19 fatal accidents over two years – making it the deadliest 4.5-mile stretch in California.
