How Long Will My Personal Injury Case Take?

The length of a personal injury case can vary widely depending on several factors, so there’s no one-size-fits-all answer. In general, a straightforward case may take a few months to resolve, while more complex cases can take a year or longer.

One of the biggest factors that affects the timeline is the extent of your injuries. It’s important to reach maximum medical improvement (MMI) before settling, so you and your attorney fully understand the costs of your recovery, including future medical care. Rushing into a settlement too soon could result in compensation that doesn’t fully cover your needs.

Another factor is whether the case settles out of court or proceeds to trial. Many personal injury claims are resolved through negotiation or mediation, which can take a few months. However, if the insurance company disputes liability or offers an unfair settlement, your attorney may recommend filing a lawsuit. Litigation involves several stages—discovery, depositions, motions, and possibly a trial—and can take a year or more.

Court schedules, the availability of expert witnesses, and the willingness of both sides to negotiate also influence the timeline. While it can be frustrating to wait, building a strong case takes time and attention to detail.
